Terms of Service

These Terms of Service govern your use of Picturental, operated by Picturental Ltd (company number 13252507), whose registered address is 66 Paul Street, London, England, EC2A 4NA ("Picturental", "we", "us" or "our").
By creating an account or using Picturental, you agree to these Terms.
1. What Picturental does
Picturental operates an online peer-to-peer marketplace for film, photography and related production equipment.
Owners can list equipment for rental and renters can request and pay for rentals through the platform.
Picturental is a marketplace operator and is not a party to the rental contract between an owner and a renter. The owner and renter are responsible for complying with the terms applicable to their rental and for the equipment during the rental period.
Picturental does not own or hold the equipment listed by owners.
2. Accounts
You must provide accurate information when creating an account and keep your account information up to date.
You are responsible for activity carried out through your account and must keep your login details secure.
We may require identity verification or other checks before allowing an account or transaction to proceed.
We may suspend or restrict an account where we reasonably believe this is necessary for security, fraud prevention, legal compliance or to protect users or the platform.
3. Listings
Owners are responsible for the accuracy of their listings, including descriptions, photographs, condition, availability and any relevant restrictions or requirements.
Owners must have the right to offer the equipment for rental.
Equipment must be accurately described and suitable for the use represented in the listing.
Picturental may remove or restrict listings that breach these Terms, applicable law or our safety requirements.
4. Rentals
A rental is an agreement between the owner and renter.
The owner is responsible for making the equipment available as agreed. The renter is responsible for using the equipment appropriately and returning it as agreed.
Picturental facilitates the booking and payment process but does not take ownership of the equipment and does not guarantee the condition, suitability or availability of equipment.
5. Fees and payments
The renter pays the amount shown at checkout.
Picturental normally charges a 12% platform fee, subject to a minimum of £1 per day, as disclosed during the booking process.
Payments are processed using Stripe and, where applicable, Stripe Connect.
Funds paid for a rental are processed through Stripe and are transferred to the owner's connected Stripe account. Picturental does not hold customer rental funds in a Picturental balance.
Applicable taxes, fees and any discounts will be displayed during the booking process where relevant.
6. Deposits
Picturental does not take or hold a cash deposit.
Where a listing displays a "deposit" or similar amount, that amount represents the maximum amount that may be claimed under the applicable damage-claim process; it does not mean that money has been paid to or held by Picturental.
7. Picturental Protect
Picturental Protect is the name used by Picturental for its damage-claim process and associated protection arrangements.
Picturental Protect is not an insurance policy and Picturental is not an insurer. There is no insurance policy or underwriter providing insurance cover under Picturental Protect.
Where equipment is damaged during a rental, the owner may make a claim through the Picturental process, subject to the applicable conditions, evidence and limits.
The maximum amount that may be claimed is the amount specified for the relevant booking or listing, subject to these Terms and the outcome of the claim process.
Picturental does not guarantee that every claim will be paid.
8. Damage claims
A renter may be responsible for loss or damage caused to equipment while it is in the renter's possession or control, subject to applicable law and the circumstances of the rental.
Where a valid damage claim is accepted, Picturental may attempt to collect the amount due using the payment method authorised by the renter for this purpose.
The payment may be processed as an off-session payment through Stripe. Where additional authentication is required, Picturental may instead issue a Stripe invoice or use another payment mechanism made available through the platform.
If a damage payment cannot be collected from the renter, Picturental does not currently guarantee or make up the unpaid amount for the owner.
Owners should therefore consider this risk when deciding what equipment to list and the maximum claim amount to apply.
9. No guarantee of recovery
Picturental does not guarantee recovery of the value of damaged, lost or stolen equipment.
In particular, the existence of a damage-claim process does not mean that Picturental will reimburse an owner where:
- a renter disputes the claim;
- a payment method fails;
- a payment requires authentication and is not completed;
- an invoice is not paid; or
- the applicable claim conditions are not satisfied.
10. Cancellations and consumer rights
Where you are a consumer, you may have statutory rights under applicable UK consumer protection legislation, including rights relating to cancellation of contracts made at a distance.
Where a statutory cancellation right applies, Picturental will not seek to exclude that right unlawfully.
Where a service is requested to begin before the expiry of an applicable cancellation period, any consent or acknowledgement required by law will be obtained during the booking process.
Certain bookings or services may be subject to statutory exceptions or different cancellation consequences. The cancellation information presented during the booking process forms part of the applicable booking terms.
Nothing in these Terms affects your statutory consumer rights.
11. Refunds
Where a refund is due, it will normally be processed through Stripe using the payment method used for the relevant booking.
A refund may result in the corresponding transfer to an owner being reversed or adjusted through Stripe.
The amount and timing of any refund will depend on the applicable cancellation terms, the circumstances of the booking and applicable law.
12. Collection, handover and return of equipment
The owner and renter are responsible for agreeing and complying with the agreed handover and return arrangements.
The renter must return equipment by the agreed time and in the condition required by the rental.
The renter should report any loss, damage or problem with the equipment to the owner and Picturental as soon as reasonably possible.
13. Use of equipment
Renters must use equipment responsibly, safely and in accordance with the manufacturer's instructions and any restrictions communicated by the owner.
Equipment must not be used for unlawful purposes or in circumstances that create an unreasonable risk of damage or injury.
The renter must not sell, lend, sub-rent, transfer or otherwise dispose of equipment belonging to an owner unless expressly authorised.
14. Liability between owner and renter
The owner and renter remain responsible for their respective obligations under their rental agreement.
Nothing in these Terms removes or limits liability that cannot legally be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that applicable law does not permit us to exclude or limit.
To the extent permitted by law, Picturental is not responsible for losses arising solely from the acts or omissions of an owner or renter.
15. Picturental's role and liability
Picturental provides the online marketplace and associated payment, booking and account services.
We do not manufacture, own or ordinarily inspect the equipment listed by owners and do not guarantee that equipment is fit for a particular purpose.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
Subject to that, where permitted by law, Picturental's liability arising from or in connection with the platform will be limited to the extent reasonably permitted by applicable law.
Nothing in these Terms affects your statutory consumer rights.
16. Reviews and content
Users may submit reviews, photographs and other content relating to their use of Picturental.
You must not submit content that is unlawful, misleading, defamatory, infringing, abusive or otherwise inappropriate.
By submitting content, you confirm that you have the rights necessary to allow Picturental to display and use that content for operating and promoting the platform.
We may remove content that breaches these Terms or applicable law.
17. Fraud and security checks
Picturental may use identity verification, payment checks and fraud-prevention tools to protect users and the platform.
These checks may be carried out through third-party providers, including Stripe.

18. Suspension and termination
You may stop using your account at any time, subject to any outstanding rental, payment or other obligations.
We may suspend or terminate access where reasonably necessary because of a breach of these Terms, fraud concerns, security concerns, legal requirements or risks to users or the platform.
Termination does not remove obligations that arose before termination.
19. Changes to these Terms
We may update these Terms from time to time.
Where a change is material, we will provide appropriate notice where required.
The version applicable to a particular booking will be identified or made available to the parties to that booking.
20. Governing law
These Terms are governed by the laws of England and Wales.
If you are a consumer, you may also have mandatory rights under the laws applicable to you that cannot be excluded by these Terms.
